    Explanation
    Protection of the rights of the child is the key issue of the national human rights policy. Slovakia as a State Party to the three Optional Protocols to the Convention on the Rights of the Child will continue their implementation. To further improve the child's protection against violence, the National Strategy for the Protection of Children against Violence was adopted in January 2014. It represents a comprehensive tool to achieve a qualitative change in the perception of violence against children aimed to create an effective mechanism for the systematic protection of children

    Para 10) … The so-called Lanzarote Convention, the Council of Europe Convention on Protection of Children against Sexual Exploitation and Sexual Abuse became effective in the SR on 1 July 2016.
    Para 12) The Act on Criminal Liability of Legal Persons effective as of 1 July 2016 introduced direct criminal liability applying to legal persons established for the purpose of committing a crime or otherwise actively engaged in criminal activities which threaten or violate the rights of others (where these are typically cases of exploitation of so-called vulnerable persons, such as women, children, ...).
    Para 30) … The SR also participated in the “HESTIA – Preventing Human Trafficking and Sham Marriages – a Multidisciplinary Solution” project, financed by the EU.     National Report Annex 1:
    Based on the requirements of application practice arising from legislative changes and from the implementation of the principles of current international directives and regulations, the new internal standard “Applying Measures of Socio-Legal Protection of Children and Social Care for Victims of Human Trafficking – Guidelines and Recommended Procedure No. 6-3/2016”, effective from 1 November 2016, was introduced to modify the internal procedure for CSLPaSP in applying measures for victims of human trafficking.

    The application of measures by CSLPaSP focuses on providing social counselling, participation in programmes focused on assisting human trafficking victims and field social work. The counselling and psychology services department primarily provides psychological counselling and psychological assistance. CSLPaSP acts as a caretaker during legal proceedings. Preventive and search activities focus on risk groups and risk situations.

    In working with human trafficking victims, a CSLPaSP proceeds according to §11 (3) of the Family Act, which imposes an obligation upon the facility, as part of measures to be applied, to apply or ensure the application of professional methods to assist children or adult natural persons who were victims of human trafficking.

    When applying these measures, a CSLPaSP closely cooperates with the police, court, prosecution, schools, school facilities, municipalities, higher territorial units, accredited entities, healthcare institutions, and other legal and natural persons engaged in this field.

    Care for minors who are human trafficking victims is provided by the Children’s Home in Topoľčany, where six professional members of staff have been trained in cooperation with the MI SR to work with human trafficking victims. In line with the tasks of the National Programme for Combating Human Trafficking, activities for children were focused primarily on information and promotion campaigns, education and preventive activities for groups at risk of human trafficking, particularly children and young adults placed in youth detention centres and unaccompanied minors.

    The Information Centre for Combating Trafficking in Human Beings and Crime Prevention plays the role of a national reporting body or that of a similar mechanism established in accordance with Article 19 of Directive 2011/36/EU of the European Parliament and of the Council of 5 April 2012 on Preventing and Combating Trafficking in Human Beings, which replaces Council Decision 2002/629/JHA.

    Trafficking in human beings is not too prominent, yet it represents a serious problem. Slovakia is primarily a source country, but several international institutions also refer to it as a transit country. Some specific types of human trafficking have been on the rise lately, namely trafficking in women for the purpose of sexual exploitation and trafficking in men for the purpose of labour exploitation. Trafficking for sexual purposes often involves minors.

    In April 2008, the government adopted a National Programme to Combat Trafficking in Human Beings for 2008-10, which represents a comprehensive national strategy to combat this phenomenon. The programme also comprises an Action Plan to Combat Trafficking in Human Beings designed to coordinate the activities of all stakeholders engaged in the elimination of risks and preventing human trafficking, as well as in creating conditions for the provision of support and assistance to victim of trafficking and safeguard the protection of human rights and dignity. The material also addresses comprehensive assistance provided to victims of human trafficking.

    The coordinating mechanism is complemented with an Expert Group on Trafficking in Human Beings chaired by the State Secretary of the Ministry of the Interior as a national coordinator. The expert group is comprised of 22 representatives of state administration, nongovernmental sector, regional/local authorities and an IOM representative in Bratislava. [Paras 82-84]

    Stakeholder Summary:
    Para 19) The SNCHR reported that hate crimes had been increasing as well as incidents of hate speech.29 The CoE-ECRI noted that hate speech was recurrent on the Internet and in part of the traditional media. It stated that anti-“minorities” rhetoric and offensive discourse targeting sexual orientation were common among politicians.
    Para 23) The CoE-Commissioner commended the progress made in the past few years by Slovakia in strengthening the policy and institutional framework for the promotion and protection of the human rights of lesbian, gay, bisexual and intersex (LGBTI) persons. However, the CoE-Commissioner was worried at the growing negative rhetoric and hate speech directed against LGBTI persons in recent years.
    Para 26) The CoE-ECRI reported that there was no adequate access to gender reassignment treatment, although this was required by law in order to change name and identification number.

    Ensure women's access to quality sexual education as well as to condoms and other means necessary for the practice of an informed and responsible sexual health.
    Explanation
    Access to contraception and abortion is regulated by law. These issues as well as sexual education and reproductive rights shall be reflected in the National Programme for Women Care, Safe Maternity and Reproductive Health, currently under preparation. Due to the absence of consensus at an expert level, its adoption has been postponed until the end of October 2015. With regard to the recommendation to improve access to contraception for women, the main objective of the national medicine policy is to ensure efficient, high-quality and safe medicines for the population. Hormonal contraception is reimbursed by the public health insurance when prescribed to treat medical problems. The Ministry of Health does not consider the free use of hormonal contraception as the highest standard of physical and mental health of women. For vulnerable women/women with low income, national authorities will seek alternative methods of contraception. Slovakia will continue to guarantee the right to conscientious objection in accordance with current legal framework.

    Para 56) All women in Slovakia have sufficient access to contraception methods. According to the data from the database of registered medicines at the State Institute for Drug Control, there are currently 387 types of hormonal contraceptives and 13 types of topical contraceptives registered in the SR that healthcare providers can prescribe to women. These contraceptives along with other forms of contraception are not covered by public health insurance, although in cases where their use is medically justified, they may be covered by a healthcare insurer from public health insurance. Condoms are freely available for sale at retail outlets.

    National Report Annex 1:
    Sexual education is a cross-cutting subject built into the study programmes of all full-time and part-time healthcare education students, which equips students with professional competence to perform professional work activities in accordance with Government Regulation No. 296/2012 Coll. on Vocational Qualifications for the Performance of Healthcare Professions, the Method of Continuing Education for Healthcare Professionals, the System of Specialisations and the System of Certified Work Activities. Condoms are freely available for sale at retail outlets.
    Education in the field of sexual and reproductive health and rights is provided within selected minimum standards for continuing education of healthcare professionals. Topics focused on sexual and reproductive health are part of the content of minimum standard theoretical knowledge in the relevant specialised study programmes and certification preparation designed for healthcare professionals involved in the provision of healthcare related to the human reproductive system. Healthcare professionals qualified as doctors (specialisation in gynaecology and obstetrics, specialisation in urology and specialisation in reproductive medicine), healthcare professionals qualified as midwives (specialization in midwifery and care for women in families and communities and certified work in planned parenthood and contraception).

    The Committee against Torture recommended that Slovakia introduce domestic violence as a specific offence in the Criminal Code, with appropriate sanctions, establish an effective and independent complaints mechanism for victims of domestic violence, and ensure that all allegations of domestic violence were effectively investigated and the perpetrators prosecuted and punished, and that victims benefited from protection. The HR Committee and the CEDAW made similar recommendations. In 2017, Slovakia announced that the Act on Victims of Crime defining the offence of domestic violence would be effective as of January 2018. [Para 24]

    In 2008, the ILO Committee of Experts noted the Government's statement that an amended version of section 119(3) of the Labour Code will guarantee "equal wage of men and women for equal work or for work of equal value". It noted also that the new Labour Code has been promulgated and came into force in September 2007 and expressed hope that the new Labour Code will now fully reflect the principle of the ILO Convention No. 100 concerning Equal Remuneration for Men and Women Workers for Work of Equal Value. The Committee noted that data show that a significant gap between women's and men's wages still exists. [Para 31]
