    National Report:
    Para 43) Concerning persons living with HIV/AIDS and given also recommendation 9, in addition to the aspects presented within the mid-term report, we underline that people newly diagnosed with HIV infection are clinically and laboratory evaluated, based on ECDC/WHO criteria, and included in the antiretroviral therapy. Efforts are made in order to avoid therapy discontinuity and patient drop-out.

    UN Compilation:
    Para 52) CRC was concerned that the proportion of young people, including adolescents, among those recently diagnosed with HIV/AIDS was high and that children affected byHIV/AIDS often experienced barriers in accessing health services. UNICEF reported that the rate of mother-to-child transmission of HIV increased in 2010 due to the fact that one third of HIV-positive mothers were not receiving either treatment or preventive care during pregnancy.

    Stakeholder Summary:
    Para 12) JS2 reported about discrimination against and segregation of women living with HIV in hospitals and cases of breach of confidentiality of patients' HIV positive status by medical personnel. JS2 highlighted the denial or hindrance of access to medical assistance during childbirth for women living with HIV and failure by some healthcare providers to take special measures to prevent HIV transmission from mother to child. The occurrences of refusal of gynecological consultations, post-abortion health care or the performance of abortion to women with HIV positive status by public health care resulted in cases of patients not treating their diseases, resorting to self-medication or unsafe abortion or not declaring their HIV status when accessing health care services. JS1 recommended that Romania raise public awareness to combat all forms of discrimination against people living with HIV / AIDS, primarily addressing the communities in rural areas.

    ACCEPT, IGLHRC & ILGA noted that one of the submitting organisations, ACCEPT, has received several complaints from individuals in detention who are perceived to be gay or transgender and as such are subjected by other inmates to rape, physical assault, and degrading treatment. However, when such inmates complain, prison authorities rarely take immediate measures to ensure their safety or prosecute the perpetrators. ACCEPT, IGLHRC & ILGA recommended that the Ministry of Justice and the National Authority of Penitentiaries should prevent abuses in detention by systematically educating prison personnel about human rights, sexual orientation, and gender identity issues. The penitentiary should promptly follow up on complaints to secure the safety of inmates and prevent their further victimization, referring perpetrators to the prosecutor. [Para 20]

    Explanation
    The Ministry of Education collects data regarding participation in education for persons belonging to national minorities; to combat school dropout, the Ministry implements the National Program for the Reduction of School Dropout, and the measures provided include the identification and registration of at-risk students in the Ministry’s database, as well as the identification and registration of children and youth out of school. The program currently targets lower secondary school students, where the school dropout phenomenon is most acute, and will be expanded to include primary education as well. ... Moreover, the new 2023 Law on Undergraduate Education provides for increased measures to tackle this phenomenon, by establishing the National Integrated Program for the Reduction of School Dropout. Pupils identified as at-risk of school dropout participate in national support programs with priority, such as the "School after School" Program, the "Remedial Learning" Program and benefit from additional support measures and facilities.

    In a joint statement, the European Region of the International Lesbian and Gay Federation and International Lesbian and Gay Association commended Romania for supporting 13 recommendations made on sexual orientation and gender identity issues, but regretted that it partially noted two recommendations on same-sex civil partnership and marriage. They noted the widespread intolerance towards lesbian, gay, bisexual and transgender persons. In the joint statement, they highlighted a need for the authorities to ensure that awareness raising campaigns on equality and non-discrimination, as well as educational and continuous learning programmes were available and implemented in schools and training centres for civil servants and other professionals. Romania needed to update legal gender recognition procedures in order to respect human rights standards.
