    The Law on equal opportunities between women and men establishes the legal framework in the field of equal opportunities. The law is based on the concept of multiple discriminations, which covers all grounds of discrimination, including gender and race. It was modified and supplemented by a Governmental Ordinance establishing the National Agency for Equal Opportunities between Women and Men. According to the Audio-Visual Law, it is forbidden to broadcast programs which contain any form of incitement to hatred on grounds of race, religion, nationality, gender or sexual orientation.     Para 88) In the field of domestic violence, the Ministry of Labor and Social Justice, through the National Agency for Equal Opportunities for Women and Men (NAEO), exercises the functions of strategy, regulation, representation and State authority and has attributions in the elaboration, coordination and implementation of the strategies and policies of the Government.
    Para 89) In order to strengthen public policy for eliminating gender based violence, including domestic violence, in 2012, the Romanian Government approved Government Decision no. 1156/2012 for the approval of the National Strategy for prevention and combating of family violence and the Action Plan for implementing the national strategy for prevention and combating of family violence for the period 2013–201726 .
    Para 90) By Law no. 30/2016 Romania ratified the Istanbul Convention imposing concrete measures on States Parties to prevent and combat violence against women and domestic violence. The Istanbul Convention proposes creating mechanisms to guarantee the protection of victims, raise awareness of the effects of the phenomenon, and prevent and combat all forms of violence.
    Para 91) In order to carry out the complex legislative steps required by the implementation of the Istanbul Convention, NAEO elaborated the necessary legislative package for the implementation of the Istanbul Convention, which includes the modification of the legislation regarding equal opportunities for women and men, on the prevention and combating domestic violence, the modification of the Criminal and Criminal Procedure Codes.
    Para 92) At the same time, the Governance Program for the period 2017–2020 provides a series of measures aimed to preventing and combating violence against women and domestic violence, and has as a prerequisite the adoption of the draft laws necessary for the harmonization of national legislation with the provisions of the Istanbul Convention and it will be transposed into secondary legislation, as well as the development of social services for victims of domestic violence and aggressors by implementing projects from European funds.
    Para 93) Another important task of the NAEO is to finance and/or co-finance programs of national interest in the field of gender equality and prevention and combating domestic violence. A number of projects were and are to be developed in order to raise awareness on this phenomenon.
    Para 95) Aspects related to domestic violence are being approached in the framework of the family law organized for the judicial trainees and for the continuous training by the National Institute of Magistracy.

    Para 121) With regard to recommendation 27, it is to be noted that the National Health Programs implemented by the Ministry of Health have constantly provided for an increased access to services of sexual and reproduction health, especially for marginalized groups.

    Para 12) JS2 reported about discrimination against and segregation of women living with HIV in hospitals and cases of breach of confidentiality of patients' HIV positive status by medical personnel. JS2 highlighted the denial or hindrance of access to medical assistance during childbirth for women living with HIV and failure by some healthcare providers to take special measures to prevent HIV transmission from mother to child. The occurrences of refusal of gynecological consultations, post-abortion health care or the performance of abortion to women with HIV positive status by public health care resulted in cases of patients not treating their diseases, resorting to self-medication or unsafe abortion or not declaring their HIV status when accessing health care services. JS1 recommended that Romania raise public awareness to combat all forms of discrimination against people living with HIV / AIDS, primarily addressing the communities in rural areas.

    In 2003 CRC remained concerned at the incidence of HIV/AIDS among young children; the high rate of new infections affecting young people, particularly among minorities; and the fact that treatment, although free, is provided only to a limited number of children and may lack continuity due to funding limitations. In 2004, the Special Rapporteur on the right to health noted that Romania had one of the highest prevalence rates of HIV and AIDS in Central Europe and the largest number of children living with HIV in Europe. While acknowledging that in recent years, the Government has led a dynamic campaign to provide treatment and care for people living with HIV and AIDS, and that in some ways, Romania's approach to HIV/AIDS treatment and care is a model, he made several recommendations regarding addressing HIV prevention as well as gender inequalities, stigma and discrimination. In 2006, the Special Rapporteur on the right to health and the Special Rapporteur on the right to education stressed continuing widespread discrimination against children and young people living with HIV/AIDS being denied adequate medical care, to which the Government provided a detailed response setting forth the legal framework and the measures taken [Para 31; SR on the right to health, CRC]

    Explanation
    From January 2018, the Prosecutor General started to collect disaggregated data on criminal offenses on the discrimination criteria provided by the Criminal Code. Since 2017, the Romanian Police have taken measures to collect disaggregated data and to initiate a methodology for investigating hate crimes.
