Type:RecommendationSession:43rd Session, May 2023Status:AcceptedContents:Further develop statistics regarding sexual violence, hate crimes and Roma children’s school attendance, and strengthen the statistical work of the Romanian authorities.
ExplanationThe Ministry of Education collects data regarding participation in education for persons belonging to national minorities; to combat school dropout, the Ministry implements the National Program for the Reduction of School Dropout, and the measures provided include the identification and registration of at-risk students in the Ministry’s database, as well as the identification and registration of children and youth out of school. The program currently targets lower secondary school students, where the school dropout phenomenon is most acute, and will be expanded to include primary education as well. ... Moreover, the new 2023 Law on Undergraduate Education provides for increased measures to tackle this phenomenon, by establishing the National Integrated Program for the Reduction of School Dropout. Pupils identified as at-risk of school dropout participate in national support programs with priority, such as the "School after School" Program, the "Remedial Learning" Program and benefit from additional support measures and facilities.

- Domestic violence
Type:RecommendationSession:2nd session, May 2008Status:AcceptedContents:To adopt and effectively implement measures to prevent and eliminate domestic violence against women.ImplementationNational Report:
Para 108) Regarding the prevention and elimination of domestic violence against women (recommendation 13), Law no. 217/2003 on preventing and combating domestic violence has been recently substantially amended by Law no. 25/2012. One of the most important improvements of the law is the introduction of the restriction order, which is a measure of protection for the victim of domestic violence that can be issued by the court. Another specific measure of protection provided by the new law aims to improve the efficiency of authorities to support and advise victims in order to resort to legal means for sanctioning domestic violence cases.
Para 109) Besides the legal improvements, a number of programs with national coverage were dedicated to this field of activity, based on a financing offered from the state budged by the Ministry of Labour, Family and Social Protection.
Para 110) Also, in December 2009, a group of 12 EU Member States among which Romania, presented a proposal for a Directive of the European Parliament and the Council on the European protection order. The proposal was adopted in 2011 (Directive 2011/99/EU of the European Parliament and of the Council of 13 December 2011 on the European protection order).
Para 111) During the year 2010, at national level 36 informal campaigns were conducted, 19 domestic violence prevention projects and also about 37.000 persons received preventive information. In conducting the activities, external partners have been involved as well. -

- Sexual abuse
Type:RecommendationSession:15th session, February 2013Status:RejectedContents:Adopt a national strategy to protect the rights of children against all risk of violence, in particular, sexual abuse ...ExplanationThe issue of child abuse, neglect and exploitation was one of constant interest for the Romanian authorities. Therefore, a number of clear measures were introduced in the main legislation governing the field of children rights, as well as in the national strategy in the sector. The Romanian legislation offers a complex approach of these issues, favoring a close cooperation between various institutions with competencies in this field. Besides the general law no. 272/2004 on children rights, other similar documents regarding the field of human trafficking were approved by the Government and significant parts of their content regarded the children protection field. In the same time, Romania adopted a national strategy within the family violence field (Government Decision no. 1156/2012), which offered a comprehensive approach of this field, where the issues regarding domestic violence in general and violence on children are seen together as a whole.ImplementationUN Compilation:
Para 53) CRC The was concerned at the general tolerance of different forms of violence against children; the limited capacity of the public system to identify, report and address cases of violence, abuse and neglect of children, as well as sexual exploitation and abuse in a cross-sectoral manner; …
Stakeholder Summary:
Para 38) JS1 noted an increase in incidents of sexual abuse against children and of sexual exploitation of children. Children had been increasingly at risk of being subject to online child sexual exploitation and child pornography. JS1 reported on legal amendments made to combat child sexual exploitation. Penalties had increased for sexual assault and rape for victims who were younger than 18 (previously 16) years old. The use of child prostitution was explicitly criminalised. The Penal Code was amended to introduce definition for child pornography. However, JS1 reported on a lack of specialised services and support for child victims of sexual exploitation.
