    Para 69) In Romania, the persons having HIV or AIDS are legally perceived as persons with disabilities. Thus, they benefit from all protective measures specifically aimed at this mentioned group. HIV-positive pregnant women are monitored in nine Regional HIV Infection Surveillance Centers where, after HIV infection has been confirmed, any person, regardless of age, gender, nationality, sexual orientation, is recorded, clinically and biologically monitored and provided specific antiretroviral therapy immediately after diagnosis. The management of HIV-positive child and adolescent patients complies with the 2013-2014 Guidelines for ARV Therapy, containing a separate chapter for this age group. Between May 2014 and August 2016, ‘Prof. Dr. Matei Balș’ National Institute of Infectious Diseases from Bucharest, as Project Promoter, under the coordination of the Ministry of Health as Program Operator, implemented the project ‘Improving HIV/AIDS and Hepatitis B and C Prevention and Control in Romania”, as part of the 2009-2014 Norwegian Financial Mechanism.

    Stakeholder Summary:
    Para 31) JS3 stated that health care units refused to treat women living with HIV for obstetrics and gynaecological needs, leading to cases when patients did not receive adequate medical treatment, resorted to self-medication or unsafe abortion, were subject to discrimination and did not declare their HIV status when accessing healthcare services. Cases of discrimination against persons living with HIV in healthcare services remained unpunished and undocumented.

    Noted. it considers that they have already been complied with. Since its EU integration, Romania transposed all six EU Directives and the European acquis in the field of gender equality. The principles of equal opportunities and equal treatment between women and men are transposed in the national legislation, institutional mechanism, public policies and are reflected at civil society level. Important concepts are regulated by the main legal act in the field, such as: direct and indirect discrimination based on sex, sexual and psychological harassment, equal pay for equal work, positive actions, multiple-discrimination, sex, gender stereotype, gender budgeting. The law also includes specific measures for implementing the gender perspective in the labour market, education, eliminating gender roles and encouraging equal participation of men and women in the decision making process. The National Agency for Equal Opportunities between Women and Men was established in 2015 with a role in implementing public policies and strategies; legislative initiatives; data collection; designing and implementing programs and awareness campaigns ; cooperating with central and local authorities and NGOs. Based on the above, Romania reaffirms its commitment to promote gender equality.

The newly adopted Law of undergraduate education foresees the introduction of Health education as a compulsory topic within the national curriculum. It is under this major generic topic that issues pertaining to sexual and reproductive health education will be approached. However, the legal framework does not provide for the concept of sexual education/comprehensive sexual education. The Ministry of Education, in collaboration with the Ministry of Health, the Ministry of Family, Youth and the Equality of Chances, local public authorities, recognised denominations and non-governmental organizations, will promote programmes for the prevention of unwanted pregnancies and early maternity among pupils. The programmes will be adapted to the age and developmental level of the pupils.

    As regards gender equality, the 2006-2009 National Strategy and Plan of Action for Equal Opportunities between women and men provide for actions to improve the situation of vulnerable categories, including those that are the most exposed to marginalization and social exclusion, because of multiple discriminations. Women are very much present in the political, social and economical life but there is still room for improvement insofar as representation at the top- decisional level is concerned. According to the assessment of the National Agency for Equal Opportunities between Women and Men (NAEO), in rural communities, women encounter obstacles in acquiring equal opportunities with men. Therefore, improving the socio-professional condition of women in rural areas is one of NAEO's priorities for 2008 (a job market for this category will be organized shortly). [Para 33]

    Para 43) Concerning persons living with HIV/AIDS and given also recommendation 9, in addition to the aspects presented within the mid-term report, we underline that people newly diagnosed with HIV infection are clinically and laboratory evaluated, based on ECDC/WHO criteria, and included in the antiretroviral therapy. Efforts are made in order to avoid therapy discontinuity and patient drop-out.

    Para 47) During 10-12 November 2010, the project "Am I different? I am talented!" was held in Bucharest within the Hospital for Infectious Diseases "Victor Babes" and it aimed to promote the principles of equal opportunities and non-discrimination and the rights of the HIV-positive youngster/children. The overall objective of the project was to inform 60 children, youngsters and the personnel of the hospital regarding the principle of equal opportunities, elements to prevent and combat discrimination and promote the knowledge and understanding by youngsters, doctors, nurses, psychologists of the right of not being discriminated, of child's rights, of certain situations which constitute discrimination deeds.

    UN Compilation:
    Para 52) CRC was concerned that the proportion of young people, including adolescents, among those recently diagnosed with HIV/AIDS was high and that children affected by HIV/AIDS often experienced barriers in accessing health services. UNICEF reported that the rate of mother-to-child transmission of HIV increased in 2010 due to the fact that one third of HIV-positive mothers were not receiving either treatment or preventive care during pregnancy.

    Stakeholder Summary:
    Para 12) JS2 reported about discrimination against and segregation of women living with HIV in hospitals and cases of breach of confidentiality of patients' HIV positive status by medical personnel. JS2 highlighted the denial or hindrance of access to medical assistance during childbirth for women living with HIV and failure by some healthcare providers to take special measures to prevent HIV transmission from mother to child. The occurrences of refusal of gynecological consultations, post-abortion health care or the performance of abortion to women with HIV positive status by public health care resulted in cases of patients not treating their diseases, resorting to self-medication or unsafe abortion or not declaring their HIV status when accessing health care services. JS1 recommended that Romania raise public awareness to combat all forms of discrimination against people living with HIV / AIDS, primarily addressing the communities in rural areas.
